Completion Meetings

Whether you are a buyer or seller the notaries will suggest you give him a power of attorney (procuration) to sign the transfer deed on your behalf so you do not have to travel to the completion meeting. 

 

This sounds sensible but should be avoided. If you give the notary power of attorney he is deemed to have power to make last minute amendments to the transfer deed to facilitate completion. 

 

This means that if the other party is present in the notary's office and prevails upon him to make final amendments which are detrimental to you he may well do so without informing you in advance.

 

It is a good idea to be present and to say no to any changes you do not understand.  This is where having a lawyer present can be helpful.
